At Birthsmarter, we take consent, transparency, shared-decision making, and privacy very seriously. We believe we have a responsibility to operate online in the same way we would in-person — and that means thinking critically about what data we collect, who we share it with, and what we're willing to trade away in the name of growth.

In order to operate digitally in alignment with Birthsmarter values, it would be our preference to move away from big tech companies like Google and Meta. They are however the primary platforms when it comes to advertising our childbirth education classes.

While we have tried to operate in a way that separates us from Big Tech platforms, we've ultimately decided it's best for Birthsmarter and Birthsmarter families to reengage with traditional advertising and data analytics while continuing to focus on our community's digital security and our company ethics.

This policy explains what information we collect when you use our website and services, how we use it, who we share it with, and the rights you have. Your information is stored and processed in the United States.

We do not sell your personal information to anyone, and selling your data will never be part of our business model or revenue stream. Because we use advertising cookies and pixels, some US state privacy laws may characterize certain data flows to advertising platforms as a "sale" or "sharing" — even though no money changes hands. Who We Are

Birth Smarter, Inc. ("Birthsmarter," "we," "us," or "our") provides pregnancy, birth, and parenting education through on-demand content and live classes (in person and virtual). Our website at (the "Service") is where you learn about, register for, and access those classes.

Your Consent

By using our website or services, you agree to this Privacy Policy and consent to how we collect and use your personal information as described here. If you don't agree, please don't use the Service.

What Information We Collect

Information you give us. When you register for a class, check out, create an account, sign up for our community or resources, respond to a survey, or contact us, you may give us:

Contact and account details — name, email, phone number, and zip code

An optional due date or baby's birthday, if you choose to provide it

Your birth goals, if you choose to share them during signup or program enrollment

Your partner's contact information, if you choose to provide it to support your care

Your marketing preference — whether you'd like to receive promotional emails

Payment information — processed directly by our payment processor; we don't store full card numbers

Professional or business details — such as a business website or social media handle — if you apply to our affiliate or partner program

Other information you choose to provide — for example, in survey responses or messages you send us

Information about your orders. When you buy or reschedule, we process details such as the classes or items you purchased, the amount, any discount or promo code applied, and reschedule details.

Information from your account. We use a secure email sign-in link (rather than passwords) to give you access to your account and any on-demand content you've purchased or registered for.

Information collected automatically. When you use the Service, we and our providers collect certain information through cookies and similar technologies — including your IP address and basic device and browser information (used for security, bot protection, and payment processing), the activity needed to operate the site, and, where you've consented, analytics and advertising measurement. We also record the website you arrived from and any partner or affiliate code in your link, so we can credit referrals. See "Cookies, Analytics & Advertising" below.

Information from service providers. We receive limited information from providers who help us operate — for example, payment confirmation and fraud signals from our payment processor.

Survey data. We collect survey data in two ways. The first is class reviews, which help us improve our programs and educators. The second is post-birth surveys, which help us understand how our classes affected your birth experience. We treat post-birth survey responses with care and will handle them consistent with this policy and any additional consent we request at the time of collection.

A Note on Sensitive Information

Some of what you share is personal and sensitive. On this website, the only health-related detail we collect is an optional due date or baby's birthday, and we never share it with our advertising or analytics tools. Separately — outside the website, through channels such as our classes, or forms and emails handled by our team — we may collect information like relevant health history, birth goals, or your partner's contact details directly from you to support your care. That information is kept separate from our website system and is never shared with advertising or analytics platforms. Where the law requires your consent to collect this kind of information, we will ask for it.

How We Use Your Information

We use the information we collect to:

Provide and operate the Service — class registration, scheduling, account access, and delivering the content you've purchased (including on-demand video)

Provide personalized support during your pregnancy, birth, or postpartum experience

Process payments and confirm purchases

Send transactional messages — receipts, sign-in links, class reminders, and service-related updates

Send marketing emails only where you have opted in (for example, a marketing checkbox at checkout or on a sign-up form); you can opt out at any time

Measure and improve our programs, marketing, and advertising — including analytics and conversion tracking, subject to your cookie choices

Credit referrals and affiliate partners for visits or purchases they send our way

Keep the Service secure, prevent abuse, and verify form submissions (for example, through bot protection)

Run surveys to improve our classes and educators

Comply with legal obligations and enforce our terms and policies

If we ever want to use your information for something not described here, we will ask for your consent where the law requires it.

Cookies, Analytics & Advertising

We use cookies and similar technologies for essential functions (like keeping you signed in and remembering your cart) and — with your consent — for analytics and advertising measurement.

We use Google Analytics to understand how visitors use our site. We also run ads on Google and Meta (Facebook/Instagram), and we use the Meta Pixel and Google Ads conversion tracking to measure whether those ads lead people to register or purchase. To do this, these tools may set cookies and share limited information with Google and Meta — for example, that a registration or purchase happened, its value, and the ad click it can be attributed to. We work to keep the health and pregnancy details you share with us out of these advertising tools.

You're in control of non-essential cookies. When you first visit, our cookie banner (provided through CookieYes) lets you accept or decline analytics and advertising cookies, and you can change or withdraw your choice at any time using the "Cookie Settings" option on our site. How We Share Your Information

We share information only as described here.

Service providers. We use trusted companies that process information on our behalf to run the Service, and we require them to use it only to provide services to us. These include providers that handle:

Payment processing

Customer and operations data (our database and CRM)

Email delivery — transactional messages and, where you've opted in, marketing

Website hosting, content delivery, and security, including bot protection

Cookie consent management for our banner

Analytics and advertising partners. We use Google (Google Analytics and Google Ads) and Meta (the Meta Pixel) to understand how our site is used and to measure the performance of our advertising, subject to your cookie choices. We did experiment with Plausible.io and recommend it to others; however, at our stage of growth it did not provide the data feedback we needed to continue investing in traditional paid advertising.

Our educators. We share what's needed with the educators supporting you so they can provide your care and instruction.

Legal and safety. We may disclose information to comply with the law or legal process, to enforce our terms, or to protect the rights, safety, and security of Birthsmarter, our users, or others.

Business transfers. We have no plans to sell Birthsmarter. But in the unlikely event of an acquisition or merger, we will notify you directly before any transfer of your personal information occurs, explain the new company's privacy practices, and provide you with the opportunity to request deletion of your data before it is transferred to any new owner.

Your Privacy Choices and "Sale/Sharing"

Because we use advertising cookies and pixels, some US state privacy laws may treat that activity as a "sale" or "sharing" of personal information for targeted advertising — even though no money changes hands. To be clear: we do not sell your personal information for money, and doing so will never be part of how Birthsmarter operates. The data flows described here exist solely to measure and improve our ability to reach families who can benefit from our programs. You can opt out:

Advertising cookies and pixels: Use the "Cookie Settings" option on our site to decline advertising cookies at any time.

Global Privacy Control (GPC): If your browser or a browser extension sends a Global Privacy Control signal, we treat it as a valid opt-out request and will automatically suppress advertising and analytics cookies for your visit. You do not need to interact with our cookie banner for this opt-out to take effect.

Your Rights

Depending on where you live, you may have the right to:

Delete your information

Receive a copy of your information (data portability)

Opt out of targeted advertising, "sale" or "sharing," and certain profiling

Withdraw consent where our processing is based on consent

To exercise any of these rights, email us at info@birthsmarter.com. We will respond as required by applicable law and will not discriminate against you for exercising your rights. If we deny a request, you may appeal by replying to our response.

Marketing: You can opt out of marketing emails at any time using the unsubscribe link in those messages or by emailing info@birthsmarter.com.

California & Nevada: California residents may request information about disclosures for direct marketing and may exercise the rights listed above. Nevada residents may opt out of the sale of personal information; we don't sell personal information for money, but you can still send that request to info@birthsmarter.com.

Live Video Sessions

If you join a live virtual session (for example, over Zoom), the session may be recorded, and you will be notified and asked to consent when you join. Recordings capture the educator, not participants. Most are deleted within about 30 days; a small number are kept in a password-protected archive, accessible only to our educators, for training and quality review. Session chat history is never stored or shared. You are always welcome to participate by voice or chat instead of video.

Information You Share in Our Programs

Our programs may let you share information with classmates, educators, or providers. What you choose to share is up to you — please be thoughtful, since we can't control how other participants use information you share voluntarily.

How Long We Keep Your Information

We keep your information for as long as you are an active participant in our programs, and afterward only as needed to meet legal obligations or resolve disputes. To have your information removed from our marketing platform or records, email info@birthsmarter.com and we'll take care of it.

Security and Breach Notification

We use reasonable administrative, technical, and organizational measures designed to protect your personal information from unauthorized access, disclosure, alteration, and loss. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and you use the Service and provide information to us at your own risk. In the event of a security breach affecting your personal information, Birthsmarter will notify you in accordance with applicable law. For users in New York, we comply with the requirements of the New York SHIELD Act, which requires notification in the most expedient time possible and without unreasonable delay following discovery of a breach affecting the private information of New York residents.

Children

Our services are intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18, and never from children under 13. If you believe a minor has provided us information, contact us at info@birthsmarter.com and we will delete it.

Third-Party Links

The Service may link to websites or services we don't control. This policy doesn't cover them, and we encourage you to read their privacy policies.

International Users

Our Service is available to users around the world. Your personal information will be stored and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you acknowledge that your information will be transferred to and processed in the United States. Regardless of where you are located, we honor Global Privacy Control (GPC) signals as a valid opt-out of the sale or sharing of your personal information for targeted advertising, as described in "Your Privacy Choices and Sale/Sharing" above.

"Do Not Track" Signals

Some browsers send a "Do Not Track" (DNT) signal. Because there is still no common industry standard for DNT, we do not respond to it. We do, however, honor Global Privacy Control (GPC) signals as described in "Your Privacy Choices" above.

Changes to This Policy

We may update this policy from time to time. We'll post the updated version on this page with a new date at the top. For material changes — meaning changes that meaningfully affect how we collect, use, or share your personal information — we will notify you by email in advance of those changes taking effect. Your continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
